Understanding the New Section 122 Tariffs for 25 Year Japan Vehicle Imports to the USA

With the recent removal of the Reciprocal Tariffs in which the Surpreme Court ruled unlawful, the White House promptly installed a new round of tariffs under Section 122 which takes effect for all imported goods from Feb 28th, 2026 for up to 150 days.

The Section 122 Tariffs is an add on tariff on top of the base duty rate in which US Customs has confirmed via a binding ruling N359221 issued to All Cleared Customs Brokerage which states the 10% Section 122 Tariff is to be added on to the normal rates of duty. For passenger vehicles this would be 2.5% plus 10%, for trucks 25% plus 10% duty.

Import Duties after Section 122 Tariffs

Passenger Vehicles - 2.5% plus 10%

Trucks - 25% plus 10%

Under the Section 122 exemption clauses for Section 232 products (9903.03.06), this exemption would not apply to 25 year vehicle imports due to the fact that 25 year vehicles is already exempted for the Section 232 Auto Tariffs, therefore importers will need to pay the Section 122 tariff to CBP instead as multiple exemptions are not allowed in this case.
