Overview

Effective August 29, 2025, the U.S. government suspended the $800 de minimis duty-free exemption (Section 321) for most shipments, including those via USPS, due to Executive Order 14324. Almost all imported goods, regardless of value or origin, are now subject to duties, taxes, and fees, eliminating the previous duty-free status for low-value mail.

Key Aspects of the New Rule (Post-August 29, 2025):

 

  • Suspension of Exemptions: The $800 threshold that allowed for duty-free, minimal-paperwork entry (Section 321) is no longer applicable to most, if not all, foreign-origin items.

  • Impact on USPS: International mail, previously often exempt, is now subjected to new procedures for calculating, collecting, and remitting duties.

  • China and Hong Kong Specifics: The de minimis exemption for these regions was already suspended effective May 2, 2025.

  • Assessment of Duties: Shipments may be subject to either an ad valorem rate or a specific duty, depending on the country of origin.

  • Exceptions: The suspension mainly targets commercial shipments. Some items, particularly those covered under special, limited, or non-commercial provisions, might still differ, but the rule aims for universal application

How to clear your USPS Mail and Courier packages from U.S Customs

A formal entry from a U.S. Customs Broker is required for Customs Clearance. This involves the submission of CBP Forms 7501+3461 with the calculated import duty for CBP to review for the release of goods.

The main criteria for CBP release of mail and courier packages if held are:

  • posting of CBP 7501+3461 with calculated duties

  • posting of Customs Bond with entry

  • formal presentation of shipping documentation such as invoice and packing list 

  • proper country of origin markings as required under the labeling and marking requirements

Most packages are typically held only for a limited time before your carrier cancels the shipment to return to sender. The recipient or the importer is required to take action to get a formal entry via the customs broker to present clearance paperwork to CBP for clearance of goods.
